What data will be collected about you?

When you visit kenticocloud.com or its subdomains, Kentico may collect information about how you use the website and the device(s) that you use to access the website. This typically includes the following information about you:

  • the Internet domain, registered company (if applicable), GeoIP information, and Internet address of the computer you are using;
  • identification of the page or service you are requesting;
  • the type of browser and operating system you are using;
  • date and time of access;
  • the Internet address of the website from which you arrived at our website;
  • cookies information.

Furthermore, when you actively submit information about you to Kentico using kenticocloud.com or its subdomains, typically when you fill in a contact form, Kentico will collect also the submitted information. The information will consist typically of your contact details and related personal data such as name, e-mail address, company, phone number, IP address, and office address.

How will Kentico use the data it collects about you and for what purposes?

Use of the site

  • In order to work properly, kenticocloud.com and its subdomains need to use cookies.   • Processing of your data for this purpose is necessary for the purposes of the legitimate interest pursued by Kentico (within the meaning of sec. 6(1)(f) of the GDPR) to respond to the submitted queries, complaints, or feedback and to improve its products and services hereby. For this purpose, the data will be processed for the period necessary to deliver the response, maximally for the period of four years. You have no legal obligation to provide the data, nevertheless, in that case, Kentico will not be able to respond.

Ordering of Kentico’s products or services

  • If you use kenticocloud.com or its subdomains to order any of Kentico’s products or services, Kentico will use the information you submit in the respective order form for the purposes of taking steps prior to entering into a respective contract. 
  • Processing of your data for this purpose is necessary to take steps prior to entering into a respective contract at your request within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed during the performance of the contract, and maximally for the period of four years after its termination. When it becomes obvious that the contract will not be concluded, the data will be processed maximally for the period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to order any of Kentico’s products or services.

Contact and lead management

  • Kentico monitors your activities on kenticocloud.com and its subdomains, collects data about your activities on kenticocloud.com and its subdomains, and uses collected data for profiling and lead scoring. Kentico may also match the collected data with other data that Kentico collects about you if you used Kentico’s products and services before or actively submit information about you to Kentico using kenticocloud.com or its subdomains, typically when you fill in a contact form. This will allow Kentico to improve the websites and services and to gather statistics about its usage. Kentico will also be able to show you more relevant and personalized content and prepare for you services, information, or offers more tailored to your needs.

Kentico Cloud Service

What data will be collected about you?

When you order the Kentico Cloud service or when you buy the Kentico Cloud service, Kentico will collect your data provided for the contract on the provision of the Kentico Cloud service (“Contract”) and in any other document made by you and Kentico in relation to the Contract, and your data provided during your registration to create an account to access the Kentico Cloud service. Furthermore, Kentico will collect other data which you provide to Kentico in relation to the performance of the Contract or the conclusion of the Contract. Collected data consist typically of contact details such as name, seat/residence, ID No./date of birth, e-mail address, and phone number, and invoicing details such as your bank account number.

How will Kentico use the data it collects about you and for what purposes?

Kentico will use your personal data for the following purposes:

Conclusion of the Contract

  • If you contact Kentico for the purpose of ordering Kentico Cloud service, regardless whether via kenticocloud.com or its subdomains or any other way, Kentico will use the information you provide to it for the purpose of taking steps prior to entering into the Contract.
  • Processing of your data for this purpose is necessary to take steps prior to entering into the Contract at your request within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed until the Contract is concluded, or until it becomes obvious that the Contract will not be concluded, the data will be processed maximally for a period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to conclude the Contract.

Performance of the Contract

  • Kentico will use your data to perform its rights and obligations arising out of the Contract, especially for the provision of the Kentico Cloud service and invoicing, and for the creation of your account and its maintenance. 
  • Processing of your data for this purpose is necessary for the performance of the Contract within the meaning of sec. 6 (1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the contractual obligations arising out of the Contract. You have no legal obligation to provide the data, nevertheless, in that case, the Contract cannot be concluded and performed.

How will Kentico process personal data uploaded to Kentico Cloud?

  • If you upload any personal data (especially personal data of third parties) to Kentico Cloud, Kentico will process the data for you, according to your instructions, as a processor of such data. Kentico shall endeavor to secure the personal data uploaded to Kentico Cloud at a high level, always in accordance with the GDPR.
  • Please note that you have to make sure the personal data are collected and uploaded to Kentico Cloud pursuant to the GDPR. Kentico is not liable for any claims arising out of the breach of this obligation.

Kentico Cloud Partner Program

What data will be collected about you?

When you participate in the Kentico Cloud Partner Program, Kentico will collect information you provide while registering for the Program, and further information which you provide Kentico with in relation to your participation in the Kentico Cloud Partner Program. Collected data consist typically of contact details such as name, seat/residence, ID No./date of birth, e-mail address, website, and phone number.

How will Kentico use the data it collects about you and for what purposes?

Kentico will use your personal data to perform its rights and obligations arising out of the Kentico Cloud Partner Program.

Processing of your data for this purpose is necessary for the performance of the contractual obligations arising out of the Kentico Cloud Partner Program within the meaning of sec. 6 (1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the contractual obligations arising out of your participation in the Kentico Cloud Partner Program, maximally for a period of four years. You have no legal obligation to provide the data, nevertheless, in that case, you cannot participate in the Kentico Cloud Partner Program.

Marketing Activities

What data will be used?

For marketing activities, Kentico uses only your basic contact details, typically name, seat/residence, e-mail address, and phone number.

How will Kentico use the data?

Kentico will use your personal data for the marketing activities only with your explicit consent, regardless whether given during your activities on the kenticocloud.com website or its subdomains.

If you give Kentico your consent for the processing of your data for marketing purposes, Kentico will use your contact details to send you marketing communications about Kentico’s products and services and about events organized by Kentico and news related to Kentico or its products or services, which you may find interesting, or otherwise contact you with these marketing communications. 

In case you give your consent for a specific marketing activity only, for example, receiving the Kentico Cloud Newsletter, Kentico will use your data only for this specific marketing activity. Please note that you can always personalize the content you want to receive via the kentico.com website using the page “Personalize Your Consent Settings”. In that case, Kentico will send you only the marketing communication according to your settings.

Processing of your data for this purpose is based on your consent within the meaning of sec. 6 par. 1 letter a) of the GDPR. Your personal data will be used only for the duration of your consent. You have no legal obligation to provide the data.

Events

What data will be collected about you?

If you attend a workshop or any other event organized by Kentico (“Event”), Kentico will collect information you provide when you sign up for the Event or during the Event. Collected data consists typically of basic contact details such as name, residence, company, telephone, and e-mail address.

How will Kentico use the data it collects about you and for what purposes?

Performance of the Event

  • Kentico will use the data to organize the Event, to perform the Event, and to provide you with the necessary services related to the Event.
  • Furthermore, Kentico may use the data in order to send you background papers and presentations from the Event, unless you let Kentico know by e-mail at privacy@kentico.com that you do not want these materials.
  • Processing of your data for this purpose is necessary to perform the respective contractual obligations (and to take steps prior to entering into respective contractual obligations at your request) within the meaning of sec. 6(1)(b) of the GDPR. For this purpose, the data will be processed until the termination of all the respective contractual obligations. You have no legal obligation to provide the data, nevertheless, in that case, you will not be able to attend to any Event.

Evaluation of the Event

  • Kentico may use your data also to evaluate the efficiency of the Event. For this purpose, Kentico may also match the collected data with other data that Kentico collects about you.
  • Processing of your data for this purpose is necessary for the legitimate interests pursued by Kentico within the meaning of sec. 6(1)(f) of the GDPR. For this purpose, the data may be processed until the termination of all the respective contractual obligations and further for the next four years.

Use of your photographs

  • If you explicitly give Kentico consent to use your photographs taken at the Event, Kentico may use the photographs to inform about the Event and anyhow promote the Event. For this purpose, the photographs may be published on Kentico’s websites or social media.
  • Processing of your data for this purpose is based on your consent within the meaning of sec. 6(1)(a) of the GDPR. Your personal data will be used only for the duration of your consent. You may withdraw the consent anytime simply by letting us know by e-mail at privacy@kentico.com. You have no legal obligation to provide the data.

Your personal data may be handed over to all companies in the Kentico Group: 

  • Kentico Software CZ s.r.o., with its registered office at Brno, Nové sady 996/25, ZIP code 602 00, Czech Republic, 
  • Kentico Software B.V., having a principal office at Hogehilweg 19, Amsterdam, 1101 CB, Netherlands,
  • Kentico Software Limited, having a principal office at 68 Lombard Street, London, United Kingdom,
  • Kentico Software, LLC, a New Hampshire limited liability company having a principal office at 15 Constitution Drive, Suite 2G, Bedford, NH, 03110, USA,
  • Kentico Software Pty Ltd., having a principal office at 83 Mount St., North Sydney, New South Wales 2060, Australia, and
  • Kentico software s.r.o., with its registered office at Brno, Nové sady 996/25, ZIP code 602 00, Czech Republic.

Furthermore, your personal data may be handed over to Kentico’s providers of professional services such as attorneys at law and tax advisors who will be bound by the rules of professional confidentiality.

Your personal data will be kept within Kentico and abovementioned third parties except where disclosure is required by law (e.g., government bodies), or except where disclosure is necessary to protect Kentico’s rights (e.g., courts).

Some of the abovementioned companies in the Kentico Group are seated outside the European Union. Therefore, your personal data may be transferred outside the European Union. As Kentico is responsible for your personal data, it always ensures that your data remains protected and secure when being transferred. The applicable safeguards are in the form of standard contractual clauses approved by the European Commission or the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks.

Your Rights Under the GDPR

As a data subject, you have all the rights under the GDPR, specifically:

  • the right to obtain confirmation from Kentico as to whether or not your personal data are being processed, and, where that is the case, access to the personal data and further information according to sec. 15 of the GDPR such as the purposes of the processing, the categories of personal data concerned, and the recipients or categories of recipient to whom the personal data have been or will be disclosed;
  • the right to obtain the rectification of inaccurate personal data concerning you according to sec. 16 of the GDPR;
  • the right to obtain the erasure of personal data under the circumstances set in sec. 17 of the GDPR, e.g., in case the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the right to obtain restriction of processing under the circumstances set in sec. 18 of the GDPR, e.g., you contest the accuracy of the processed personal data;
  • the right to receive your personal data, which you have provided to Kentico, in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from Kentico under the circumstances set in sec. 20 of the GDPR;
  • the right to object to processing of your personal data based on legitimate interests pursued by Kentico (within the meaning of sec. 6(1)(f) of the GDPR) or to processing for direct marketing purposes, pursuant to sec. 21 of the GDPR.

Other Aspects of the Data Processing

a) Using in order to protect Kentico’s rights and legitimate interests

Kentico may use your data also to avoid potential litigations against it and to defend its rights and legitimate interests (especially before courts) related to the purpose for which the data were processed specified in this Privacy Policy (e.g., the performance of the Contract, or participation in the Kentico Cloud Partner Program).

Processing of your data for this purpose is necessary for the legitimate interests pursued by Kentico within the meaning of sec. 6(1)(f) of the GDPR. For this purpose, the data may be processed for the period adequate to the relevant limitation periods, usually up to eleven years from the date when the last limitation period commences. This period suspends in case you assert any claim against Kentico related to the relevant purpose of processing of your data until the final decision of the court having jurisdiction in this case.

b) Data of contact persons

In case you hand personal data of your contact person, or any other third person, over to Kentico, please make sure that the personal data are handed over in compliance with GDPR. Specifically, please ensure that such person is duly informed that their personal data will be handed over to Kentico and for what purpose.

Kentico may use the personal data for the purpose they were handed over, typically to communicate with you in case of personal data of a contact person. Processing of the personal data is based on the legitimate interests pursued by Kentico within the meaning of sec. 6(1)(f) of the GDPR.

c) Data security

Any information you provide to Kentico is safeguarded and secure. To prevent unauthorized access, maintain data accuracy, and ensure the correct usage of information, Kentico has put in place appropriate physical, electronic, and managerial procedures.

Access to your personal information is restricted to those Kentico employees who need to know that information in order to process it. These individuals are bound by confidentiality obligations and may be subject to disciplinary action, including job contract termination, if they fail to meet those obligations.

d) Third party sites

On kenticocloud.com or its subdomains, you may find links to websites of third parties. These websites are independent of Kentico and Kentico is not liable for the privacy practices of these third parties. Kentico, therefore, encourages you to get familiar with their privacy policy, as it may differ from Kentico’s.
